WRITTEN HEALTH GUARANTEE

BELLA’S HOUSE OF DOODLES

 

This agreement is between Bella’s House of Doodles (Seller) and ________________________________ (Buyer). It is agreed between Seller and Buyer as follows:

Seller’s Representations:

Bella’s House of Doodles takes great pride in raising healthy, well-socialized puppies. This puppy is guaranteed to be free from life-threatening genetic or congenital defects for a period of one (1) year from the puppy’s date of birth. If a licensed veterinarian determines that the puppy has a life-threatening genetic or congenital condition that prevents the puppy from living a normal life and may warrant euthanasia, Buyer may be eligible for a replacement puppy from a future available litter, at Seller’s discretion based on Buyer’s compliance with this agreement. Replacement puppies hold no cash value and are not redeemable for refunds.

To qualify:

• Seller must be notified within two (2) business days of diagnosis

• Buyer must provide full veterinary records, diagnosis, and veterinarian contact information

• Seller reserves the right to require a second opinion from a veterinarian of Seller’s choice, at Seller’s expense

A replacement puppy is contingent upon return of the original puppy, unless otherwise agreed to in writing. Shipping or transportation costs (if applicable) are the responsibility of the Buyer.

Conditions must be confirmed by a licensed veterinarian and supported by appropriate diagnostic testing. Conditions determined to be influenced by environmental factors, injury, or preventable illness are not covered. No replacement will be provided if the puppy is euthanized without prior written approval from Seller and, when requested, a second opinion.

Buyer Responsibilities

To maintain the validity of this health guarantee, Buyer agrees to:

• Have the puppy examined by a licensed veterinarian within 72 hours of pickup

  • Failure to complete this exam voids this health guarantee

• Provide routine veterinary care, vaccinations, and deworming as recommended by their veterinarian

• Maintain proper nutrition, environment, and general care

 

This guarantee does not cover conditions resulting from minor illnesses or health issues, including but not limited to:

• Respiratory infections, bacterial or parasitic infections

• Travel stress or stress-related conditions

• Conditions caused by environmental factors, injury, neglect, or improper care

• Allergies or skin conditions

• Reactions to vaccinations or medications

• Digestive upset, including stress colitis or diarrhea

• Internal or external parasites

• Contagious illnesses (including but not limited to canine parvovirus)

• Murmurs, UTIs, vaginitis, umbilical hernia, or malocclusion

Additionally, any condition deemed non-life-threatening or manageable with routine veterinary care is not covered under this guarantee.

General Ownership Agreement

Buyer understands and agrees:

• This guarantee is non-transferable and applies only to the original Buyer

• Deposits and payments are non-refundable

• If Buyer is unable to keep the puppy, Bella’s House of Doodles must be notified and given the opportunity to assist with placement or take the puppy back

Buyer agrees that this puppy will be raised as a companion animal and provided proper care, training, and socialization.

Seller makes no guarantees regarding adult size, weight, coat, temperament, or behavior, as these are influenced by genetics, environment, and training.

Seller is not responsible for any veterinary expenses incurred after the puppy leaves our care

Buyer agrees to hold Seller harmless from any claims, damages, or liabilities arising from ownership of the puppy after transfer

Extended Health Guarantee:

Animal Health is Breeder's top priority. NuVet Plus Immune System Builder and Life's Abundance Dog Food is recommended as part of your pet’s extended health guarantee. As the breeder I feel so strongly about NuVet supplements and Life's Abundance food the health guarantee will be extended to 3 years when Buyer follows breeder-recommended nutrition and supplementation practices.

 

You agree to provide the puppy with regular veterinarian care including vaccinations and dewormings due at your vet’s recommendations. All expenses incurred after the puppy leaves our premises are strictly the responsibility of the buyer. Seller assumes no responsibility for medical expenses, landlord disapprovals, allergies to animals, or any other reason not stated. You also agree to never place this puppy into a shelter for unwanted animals but will guarantee this puppy will be placed into a loving home if a situation arises where you're unable to care for it. Alternatively the puppy may be returned to Bella's House of Doodles to be placed. 

All puppies are sold as pet-only unless otherwise agreed in writing. Buyer agrees to spay or neuter the puppy within the timeframe outlined below and provide proof within 14 days of completion.

Failure to comply:

• Voids the health guarantee

• Constitutes breach of contract

Buyer agrees to pay $7,000 in liquidated damages, representing a reasonable estimate of damages incurred, in addition to any legal fees associated with enforcement.

Full and Final Agreement

The Parties agree that this writing represents the entire Agreement between them and that no other representations, either oral or written, have been made regarding the dog described above. The parties further agree that no changes in this contract shall be binding upon either of them without written modifications signed by both parties. 

Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State of Minnesota.

SPAY/NEUTER AGREEMENT (LEGALLY BINDING ADDENDUM) 

Permanent ownership of this dog is contingent upon your compliance with this Addendum. This dog is sold strictly as a companion animal with no breeding rights granted, unless otherwise agreed to in writing. The Breeder must receive proof of the spay/neuter procedure having been performed no later than the female becoming 6 months and the male puppy becoming 9 months of age. Proof must be received within fourteen (14) days after completion of the surgery. This notice can be in the form of a Certificate of Spay/Neuter or an invoice from the veterinarian showing the procedure has been completed. In the event the dog’s health does not allow this agreement to be honored, Breeder must be provided with a statement from your veterinarian that this dog is not medically appropriate for surgery at that time. Based upon the veterinarian’s evaluation, Buyer agrees to schedule the procedure at the earliest appropriate date. Surgery must be completed within a reasonable timeframe as determined by the attending veterinarian and communicated to Breeder in writing. Buyer will notify Breeder of this amendment in writing, at which time all other terms of this agreement remain in full force and effect. It is the responsibility of the Buyer, not the veterinarian, to ensure that the Breeder has received verification that the surgery has been performed. Failure to comply with this agreement, unless otherwise agreed to in writing, will be considered a breach of contract. Buyer agrees to pay $7,000 in liquidated damages, representing a reasonable estimate of damages incurred by Breeder due to breach of this agreement, in addition to any legal fees associated with enforcement. This amount is separate from and in addition to the original purchase price and is not subject to offset or reduction. Failure to comply will also result in the Health Guarantee being null and void. Buyer agrees that Breeder has the right to pursue legal action to enforce this agreement if necessary. Buyer agrees that this dog will not be used for breeding purposes under any circumstances. Any attempt to breed or allowing the dog to remain intact beyond the required timeframe without approval will be considered a breach of this agreement. In the event of any breeding, whether purposeful or accidental, Buyer agrees to pay the full breeding rights fee of $7,000 and remit any profits or proceeds from the resulting litter to Breeder. This agreement remains binding regardless of transfer of ownership unless expressly released in writing by Breeder.

By signing below, I the Buyer agree to have this dog spayed/neutered by no later than ___________. This date reflects the required deadline outlined above and is binding unless otherwise agreed to in writing.
